The issue of the function of art is only incidentally raised in H.s philosophy of right. This reticence is one of the consequences of the so-called thesis of the “end of art” (I). The present essay aims at interpreting this thesis in a political perspective. By doing so I intend to show how that very reticence opens the way to investigate the modern function of art as well as the modern confi guration of the relationship between the individual and the state. To this goal I will reconstruct the two pertinent contexts of the philosophy of art (II) and of right (III) as well as the constructive sense of art as “formalism of subjectivity” (third moment of romantic art). Just because of its partial and past character this art can be interpreted as a time-adequate spiritual and political expression (IV). Here comes the central thesis: on one side, art has now the basic capacity of transmitting different options in terms of action and refl ection in a non-binding and fi ctional, yet indirectly effective way. On the other side art is shown to play a paradigmatic function with regard to the role of individual Bildung for the modern political life, based on its formal contribution to the securing and the enrichment of the individual’s particular sphere (V). Furthermore this perspective allows one to deal with specifi c problems of H.s philosophy of right in a successful and H.-immanent way, and to confute commonplace prejudices about it (VI).
