The paper aims at investigating the role of the Italian Chief of State in controlling the extraordinary legislative powers that the art. 77 of the Constitution assigns to the Government, and verifying whether and how the financial crisis had affected this function. In particular, it analyzes the foundations and the substantive nature of the presidential power of supervise the “constitutional fairness” of the decrees made by the Government, studying the concrete choices by the Italian Presidents during the last 30 years (since the presidential power was effectively employed), and tries to underline the impact of the crisis, specially interpreting the very long mandate of the President Napolitano.
