The census is a crucial document for determining how federal funds are allocated and how congressional districts are drawn for the following 10-year period and it is meant to account for everyone living in the United States, not just US citizens. The dispute arose in March 2018, when Secretary of Commerce announced that the 2020 census would include a question about citizenship (not asked of all recipients since 1950), but the decision drew an immediate legal challenge from New York and other state, local governments and immigrants’ rights groups. The challengers contended that could lead States with large immigrant populations – which tend to lean Democratic – to lose seats in the U.S. House of Representatives and federal fundings. In June 2019 the Supreme Court temporarily blocked the plan to add a citizenship question to the 2020 census, but later the Trump administration was forced, due to the time needed to carry out the census, to eliminate definitely the disputed question.

Il censimento è un documento cruciale nella dinamica politico-istituzionale statunitense perché la Costituzione prevede che lo si debba utilizzare ogni dieci anni per calcolare il numero dei residenti (e non dei soli cittadini) presenti nel Paese, conteggio necessario poi per ripartire tra gli Stati i seggi della Camera dei Rapresentanti (e quindi anche i Grandi Elettori presidenziali), nonché per allocare i fondi federali. Il census case è nato nel marzo 2018, quando il Segretario al Commercio ha annunciato che il censimento del 2020 avrebbe di nuovo incluso una domanda sulla cittadinanza (non richiesta dal 1950). Tale decisione è stato subito contestata in giudizio da diversi Stati (tra cui New York), da governi locali e soprattutto da molti gruppi per i diritti degli immigrati in quanto avrebbe portato gli Stati con molti immigrati (che tendono a sostenere il partito democratico) a perdere seggi nella Camera dei Rappresentanti degli Stati Uniti e finanziamenti federali. Nel giugno 2019 la Corte Suprema si è pronunciata sulla controversia in Department of Commerce et al. v. New York et al, decidendo di bloccare temporaneamente l’inserimento della domanda, ma l'amministrazione Trump, a causa dei tempi tecnici previsti per la stampa dei questionari, è stata poi costretta a eliminare in via definitiva la citizenship question dal censimento del 2020.
