Constitutional freedom of movement seemed to be a staple among fundamental rights, given substantially for acquired in the legal discourse for the only purpose of exemplifying the institution of the reinforced law reserve: from the post-war period to today there had never been a reason to seriously question it throughout the country, and indeed its size had seen an expansion due to the process of european integration. The very serious health epidemic of COVID-19 forced us, among other things, to reflect on the mechanisms of emergency legislation, as well as on the impact of exceptional public health measures on our basic freedoms (even that of walking). The contribution investigates the measures of containment and contrast to the virus adopted by the italian Government, proposing to highlight the restrictions on the right to move: in particular, it wants to reflect on the latitude that the freedom to leave the house still retains, even in the emergency phase; therefore on the assumptions that justify it and on those that, instead, recognize it as legitimate ab initio. The legislative study allows, finally, to draw a distinction within the concept of freedom of movement, allowing to see, in addition to the wider right of locomotion in the proper sense, an essential content less yielding to limitations, consisting of the faculty, although limited in space and time, to move away from the private dimension.

La libertà costituzionale di circolazione pareva ormai essere un punto fermo tra i diritti fondamentali, data sostanzialmente per acquisita e richiamata nel discorso giuridico al solo fine esemplificativo dell'istituto della riserva di legge rinforzata: dal dopoguerra ad oggi non vi era mai stato motivo per rimetterla seriamente in discussione sull'intero territorio nazionale, ed anzi la sua portata aveva visto un ampliamento in ragione del processo di integrazione comunitaria. La gravissima epidemia sanitaria di COVID-19 ci ha costretto, tra le altre cose, a riflettere sui meccanismi di normazione emergenziale, nonché sull'incidenza delle misure eccezionali di sanità pubblica sulle nostre libertà basilari (finanche quella di passeggiare). Il contributo indaga le misure di contenimento e contrasto al virus adottate dal Governo, proponendosi di evidenziare le restrizioni al diritto di spostamento: in particolare, si vuole riflettere sulla latitudine che la libertà di uscire di casa tutt'ora conserva, pur nella fase emergenziale, quindi sui presupposti che la giustificano e su quelli che, invece, la riconoscono legittima ab initio. La disamina della normativa consente, infine, di tracciare una distinzione all'interno della stessa libertà di circolazione, permettendo di scorgervi, oltre al più vasto diritto di locomozione in senso proprio, un contenuto essenziale meno cedevole alle limitazioni, consistente nella facoltà, ancorché limitata nello spazio e nel tempo, di allontanarsi dalla propria dimensione privata.
