I modelli "familiari" nazionali alla prova della regolamentazione europea

The adoption of the EU Regulations no. 1103 and 1104 of 2016 on the patrimonial relationships between spouses and within registered partnerships, poses the necessity to identify their respective areas of application among the different countries with regards especially to the types of “families” that can be formed. This work aims at comparing the Italian legal framework with the European Union’s regulations in order to understand whether or not they are compatible, and to underline the difficulties that the interpreter may face.

L’emanazione dei Regolamenti UE nn. 1103 e 1104 del 2016 sui rapporti patrimoniali tra coniugi e nelle unioni registrate pone la necessità di individuare i rispettivi ambiti di applicazione, in riferimento alle formazioni «familiari», così come si configurano nei diversi Stati. Il saggio si propone di verificare i limiti di coincidenza e di compatibilità delle differenti tipologie di unioni di tipo familiare presenti nell’ordinamento italiano con quelle che hanno costituito il presupposto della normativa regolamentare, mettendo in luce le rilevanti problematiche che l’interprete si trova ad affrontare.
