The paper aims to show the Romanistic foundations of the Spanish insolvency reform de mecanismo de segunda oportunidad (Rdl 1/2015, de 27 de febrero y Ley 25/2015, de 28 de julio), starting from the link, explicitly identified by the Spanish legislator, between this legislation and Ley 3a, Título XV, Partida V, Ley de las Siete Partidas, about the beneficio de exoneración del pasivo insatisfecho. Then, the paper focuses on the relationship between Ley 3a and its Roman ancestors, in the context of the Justinian discipline of cessio bonorum, finally, it moves on to discover the implicit historical foundations of the other pivotal institution of the Spanish ‘second chance’ reform, named acuerdo extrajudicial de pagos.
