The article analyses the measures laid down in the New Pact on Migration and Asylum which aim at strengthening the digital surveillance at the EU’s external borders. After having recapped the existing legal framework, attention has been paid to the use of database within the proposal introducing a screening of third country nationals at the external borders and to the relevant provisions foreseen by the proposal to recast the Eurodac regulation. The inquiry is carried out always bearing in mind that the securitarian logic that is apparent from the extended use of digital technologies for border surveillance should not be to the detriment of fundamental rights of migrants.
Nel presente articolo vengono analizzate le misure che, all’interno del nuovo Patto sulla migrazione e l’asilo, mirano al rafforzamento della sorveglianza digitale delle frontiere esterne dell’Unione. Dopo aver riepilogato il quadro giuridico esistente, viene prestata particolare attenzione all’impiego delle banche dati nell’ambito della proposta volta ad introdurre una procedura di pre-ingresso, nonché alle novità previste nella proposta di riforma del regolamento Eurodac. L’indagine viene condotta tenendo come costante riferimento l’esigenza che la logica securitaria che caratterizza l’ampliamento dell’impiego delle tecnologie digitali non vada a discapito della tutela dei diritti fondamentali dei migranti che sono sottoposti ai controlli alle frontiere.
