In view of the implementation of the Directive (EU) 2019/771 on business-to-consumer sales of goods, the present essay discusses the possible changes that the Italian legislator could make to domestic rules, with respect to the professional’s delivery obligation and the passing of risk, in order to make them more harmonious, from a systematic point of view, and more congruent with the objectives pursued by the European law.

In vista dell’attuazione della Direttiva (UE) 2019/771 sulle vendite di beni mobili ai consumatori, il saggio riflette sulle modifiche che il legislatore italiano potrebbe apportare alla disciplina interna, relativamente all’obbligo di consegna del professionista e al passaggio del rischio, onde renderla più armonica da un punto di vista sistematico e più coerente rispetto agli obiettivi perseguiti dalla normativa europea.

Abstract
