Through the analysis of a selection of decisions and resolutions, the paper shows how difficult it is to identify for the Internet access a definition of general scope. In fact, in the texts of the constitutions and in the case law of the constitutional and supreme courts the Internet access has different definitions, depending on the definition of the Internet itself (sometimes considered a simple means of communication, albeit completely new, at other times conceived as a dimension in which people express and develop themselves) and on the kind of protection that Government must ensure to the Internet access, which is conceived either as a simple freedom or as a social right.
Lo scritto presenta una selezione di decisioni e di risoluzioni dai quali emerge la difficoltà di identificare una definizione dell’accesso a Internet valida in generale. In effetti, nei testi delle costituzioni e nella giurisprudenza delle corti costituzionali e supreme l’accesso a Internet viene definito in maniera diversa, a seconda della qualificazione che si dia a Internet (talora considerato un semplice mezzo di comunicazione, pur se del tutto nuovo, talaltra concepito come una dimensione in cui si esprime e si forma la persona) e degli obblighi che ricadano sui pubblici poteri per garantire l’accesso, inteso ora come una semplice libertà ora come un diritto sociale.
