This essay originates from the «Verbal Note» that the Holy See sent to the Italian Government to express its opposition against a draft law approved by the Chamber of Deputies and still under examination by the Senate (DDL Zan against homophobia). The analysis moves on a scientific level by a preliminary brief history of events, it later deals with the issues of legal relations between State and Church, and finally examines some substantial profiles. The intent is to highlight both the legal illegitimacy of diplomatic intervention in the light of the principle of non-interference in the internal affairs of another State, and its inappropriateness in terms of the lack of protection of the rights of LGBT+ people.
