Argentina after the military dictatorship is an interesting case study of transitional justice in a post-conflict society. The article takes inspiration from the recent decision of the Supreme Court of Argentina that declared null and void the “Full Stop” Act and the “Due Obedience” Act adopted under the Alfonsín Government. It also underlines the influence of international law in the legal reasoning of the Supreme Court. In particular, taking Argentina as a case study, the Author examines the limits that international law provides for when an act of amnesty jeopardizes the prosecution of crimes against humanity in order to verify whether the democratic transition process can be considered satisfactory.
