The paper is aimed at analyzing the innovative and instrument of the so-called “community entrepreneurs” as innovative and subsidiary solutions. These enterprises were little known until a few years ago, trapped between the rough periods of expansion of classical business and those of public intervention in economics.Nowadays the community entrepreneurs are object of renewed interest, also following the pandemic emergency, which has captured the attention not only of the doctrine, but also that of the policy makers, and even of the Court constitutional (ruling no.131 of 2020). The focus of the papers is analyzing this new organizational form that goes beyond the dichotomy between social enterprise and profit enterprise, which has come to the identification of a new declination of the principle of subsidiarity, rectius of “community”
Il contributo è volto ad analizzare lo strumento delle c.d. “imprese di comunità”, quali soluzioni sussidiarie innovative, fino a pochi anni fa poco conosciute, intrappolate tra i periodi di massima forza ed espansione dell’impresa classica e quelli dell’intervento pubblico in economia, ed oggi oggetto di un rinnovato interesse, anche a seguito dell’emergenza pandemica, che ha catturato l’attenzione non solo della dottrina, ma anche quello dei policy maker, ed addirittura della Corte costituzionale (sent. n. 131 del 2020). Ed è nell’analizzare questa nuova forma organizzativa, che va al di là della dicotomia tra impresa sociale e impresa profit, che si è giunti all’individuazione di una nuova declinazione del principio di sussidiarietà, rectiusdi “comunità”
