Una ragionevole obbedienza. Alcune considerazioni filosofico-giuridiche intorno a un tema sempre attuale

Starting from a critique of the Kelsenian thesis of the ‘contrast’ between command and obedience, the article intends to suggest a recovery of the Hobbesian theory of obedience, which is reread by highlighting significant and useful profiles of complexity to constitute a discussion plan and of possible integration for those postmodern theoretical orientations which are characterized by a discursive and/or relational approach to the theme of obedience and, more generally, to law.

A partire da una critica della tesi kelseniana della ‘contrapposizione’ tra comando e obbedienza, l’articolo intende suggerire un recupero della teoria hobbesiana dell’obbedienza, che viene riletta mettendone in luce profili di complessità significativi e utili a costituire un piano di discussione e di possibile integrazione per quegli orientamenti teorici postmoderni che si caratterizzano per un approccio discorsivo e/o relazionale al tema dell’obbedienza e, più in generale, al diritto.
