The decision in question is part of the panorama of rulings which, in recent decades, have shown a greater inclination to recognise the professional liability of lawyers. Starting from the two general rules (art. 1176, paragraph 2, Civil Code and art. 2236 Civil Code), the analysis will retrace the interpretative evolution that has concerned this specific hypothesis of liability also in the light of the orientation of the German system. Finally, the central role played by the dichotomy between obligations of means and obligations of result will be discussed, looking in particular at the repercussions of the distinction in the context of the burden of proof.
La sentenza in commento si inserisce nel panorama delle pronunce che, negli ultimi decenni, hanno mostrato una maggiore propensione nel riconoscere la responsabilità professionale dell’avvocato. Partendo dalle due regole generali (art. 1176, comma 2, c.c. e art. 2236 c.c.), si ripercorrerà l’evoluzione interpretativa che ha riguardato questa specifica ipotesi di responsabilità anche alla luce dell’orientamento dell’ordinamento tedesco. Ci si soffermerà infine sul ruolo centrale svolto dalla dicotomia obbligazioni di mezzi e obbligazioni di risultato, guardando in particolare alle ripercussioni della distinzione nell’ambito dell’onere della prova.
