Disturbance of a Religious Services and Mafia’s Exploitation. Some Notes on the Judgment of the Court of Cassation No. 2242 of 2022 · The judgment of the Court of Cassation No. 2242 of 2022 expands the interpretation of art. 405 of the Criminal Code, implicitly acknowledging the most recent magisterium of the Church on the fight against the mafia. This judgment, however, also reflects the structural weaknesses of the system of criminal law, which still awaits to be conformed to the constitutional, supranational and international standards for the protection of freedom of religion and conscience.
