Per una geografia dei diritti umani. Il caso del conflitto russo-ucraino.

The issue of human rights is as important and central as ever in the new global order. As is well known, the financial and technological capitalist system based on deregulation and competition tainted by unfair form of competition (dumping) has generated new forms of conflict and violation of human rights. While nation-states are weaker as expressions of small and unsustainable markets, regional or supranational associations ( stronger markets) could create favourable conditions for the protection of rights. Unfortunately, as emerges from the essay, the contradiction between the ideal and the real plane of human rights still persists, given the violations that have punctually occurred. Furthermore, the study discusses the recognition of violations and the related protection of human rights through International Organisations and Courts, also focusing on the jurisdictional, para-jurisdictional, control and censure procedures of the institutions concerned. Obviously, the effectiveness of the latter depends on the existence of international norms that bind states to follow the decisions of these bodies and on the establishment of international odies that oversee the execution of these decisions: thus, the case of the Russian-Ukrainian conflict is studied in relation to the violation, respect and protection of human rights.
