Effettività dei diritti sociali nell'emergenza

Analysis takes as its point of departure the tightness and effectiveness of social rights to tightness of the emergency, as the protection of each right became dependent, to a much greater extent than in the ordinary, on requirements involving the protection of other rights, in a balancing act between social rights and freedom rights, between different social rights, as well as between different faces of the same right. To configure that of limiting, when conditions call for it, fundamental rights as a duty for legislature raises the age-old question of penalty for any failure to do so.

Lo scritto analizza il tema dell'efficacia dei diritti sociali alla prova dell'emergenza. La pandemia ha evidenziato come la tutela di ciascun diritto, in situazioni emergenziali, dipenda, in misura assai maggiore che nell'ordinario, da esigenze di tutela di altri diritti, in un difficile bilanciamento tra diritti sociali e diritti di libertà, tra diversi diritti sociali, nonché tra facce diverse dello stesso diritto. Lo scritto indaga in particolare sul “diritto alla salute Covid” come diritto alla salute “qualificato”. Riflessione sul potere/dovere del legislatore di limitare, ove occorra, i diritti fondamentali e sull'antica questione delle sanzioni per il suo eventuale inadempimento.
