On 16 March 2023, the Ministers of Justice, Defense and Foreign Affairs presented the Cabinet with a proposal for a Code of International Crimes, resulting from a lengthy process that began with the contribution of the "Palazzo - Pocar" commission. The Cabinet postponed the discussion on Crimes against Humanity and Genocide to an undefined date, announcing a bill (the outcome of which is also uncertain) referring only to War Crimes and Aggression Offenses. This paper describes the basic choices made by the Commission, also in terms of legislative technique, and argues how that Code in its entirety was both necessary, for the purposes of Italy’s complete and effective compliance with the Rome Statute, and appropriate, also for the purpose of complying with the rule of organic law in line with the constitutional principles.
Il 16 marzo 2023, i Ministri della Giustizia, della Difesa e degli Esteri hanno presentato in Consiglio dei ministri una proposta di Codice dei Crimini internazionali, esito di una lunga elaborazione che ha avuto il suo inizio con il contributo della commissione “Palazzo - Pocar”. Il Consiglio dei ministri ha rinviato a incerta data una riflessione su crimini contro l’umanità e di genocidio, annunciando un disegno di legge (anch’esso dalle incerte sorti) riferito solo ai Crimini di guerra e di aggressione. Nel testo si illustrano le scelte di fondo compiute dalla Commissione, anche quanto a tecnica della legislazione, e si argomenta su come quel Codice nella sua completezza fosse vuoi necessario, ai fini di un pieno ed efficace adeguamento dell’Italia allo Statuto di Roma, vuoi opportuno, anche allo scopo di corrispondere alla riserva di legge organica in termini costituzionalmente orientati.
