The essay tackles the issue of work within value chains. Once outlined the requirements for a genuine and legitimate outsourcing process, through the analysis of article 29 (1), d.lgs. n. 276/2003, the essay examines the main instruments to protect worker’s rights, focusing on the domestic legal framework, its critical aspects, and possible future perspectives, to identify instruments suitable to guarantee sustainable outsourcing processes.
Il saggio affronta il tema del lavoro prestato nell’ambito delle catene del valore. Delineati i confini delle legittime forme di esternalizzazione, attraverso l’analisi della nozione di appalto contenuta all’art. 29, co. 1, d.lgs. n. 276/2003, il presente contributo analizza il sistema di garanzie previsto dal nostro ordinamento a tutela dei lavoratori coinvolti nelle catene del valore, approfondendone la disciplina regolativa, le criticità e le possibili prospettive future, al fine di individuare strumenti idonei a garantire processi di esternalizzazioni sostenibili.
