The research examines the nature of the effects of the bankruptcy arrangement, which in some important Italian statutory legislations are considered as unstable ('rebus sic stantibus'), because it is explicitly prescribed that the bankrupt, if he returns to better fortune, will have to pay his creditors the residual debt, in addition to that agreed in the arrangement. Starting from Stracca's reflection about this theme, the essay examines the premises of this reflection and the results of it in the following scientia iuris, up to the threshold of today's commercial legislations, focusing on the basis of the bankruptcy arrangement, identified in the 'inopia debitoris'.
La ricerca prende in esame la natura degli effetti del concordato fallimentare, che in alcune importanti legislazioni statutarie italiane vengono ritenuti instabili ('rebus sic stantibus'), dato che vi si prescrive esplicitamente che il fallito, se ritornerà a miglior fortuna, dovrà pagare ai propri creditori il debito residuo, rispetto a quello pattuito nel concordato. Partendo dalla riflessione di Stracca, il saggio esamina le premesse della sua riflessione e gli esiti di essa nella 'scientia iuris' a lui successiva, fino alle soglie delle odierne legislazioni commercialistiche, soffermandosi sul fondamento dell'accordo concordatario, individuato nella 'inopia debitoris'
