Malattie infettive, salute e sviluppo: implicazioni economiche e risposte giuridiche. Uno sguardo d'insieme ai profili di rilievo penale

By presenting the results of a research project, the paper deals with some profiles of criminal liability prompted by the onset of infectious processes. The essay shows special attention to the issues raised by the past pandemic experience. On one hand, it assesses the criticalities of the penal regulatory solutions especially adopted as an emergency to deal with the risks of spreading the new virus. On the other hand, it underlines how the obligations to prevent contagion risks tend to expand, but difficulties arise in attributing crimes dependent on events, due to the lack of adequate parameters for ascertaining the causal link and for the affirmation of the negligence.

Nel presentare gli esiti di un progetto di ricerca, lo scritto affronta certi profili di responsabilità penale sollecitati dall’insorgere di processi infettivi. Particolare attenzione è dedicata ai temi sollevati dalla trascorsa esperienza pandemica. Il saggio valuta, anzitutto, le criticità delle soluzioni penali specificamente adottate in via di emergenza per fronteggiare i rischi di diffusione del nuovo virus. D’altra parte, esso mette in evidenza come tendano a espandersi gli obblighi di prevenzione dei rischi da contagio, ma sorgano poi difficoltà ad imputare i reati di evento, a causa della mancanza di adeguati parametri per accertare il nesso causale e per affermare la responsabilità colposa.
