This paper aims to analyse the decision n. 32/2021 of the Italian Constitutional Court, in which the Court responds to the question raised with regards to the constitutionality of articles 8 and 9 of the law 40/2004, and article 250 of the civil code. First it focuses on the reasoning followed by the Supreme Court in rejecting the question. Then it highlights which kind of problems arise from the Court application of the best interests of the child principle to the case of children of homosexual couples born through ART. Finally, the last part provides a different approach to the case.
