B.C. and, specifically, the news on speculations related to entrepreneurial exploitation of multipurpose and multi-dwelling real estate buildings with vertical development (insulae), a rescript of Servius-Alfenus (handed down in D. 19.2.30 pr.) is analysed in order to verify whether the 'necessary' demolition of the tenement buildings that have become unusable and the consequent deductio ex mercede can be traced back to the force majeure paradigm or not.
