In this article I reconstruct and discuss the theses advanced by F.J. Ansuátegui Roig regarding the nature of the constitutional state. In particular, I consider the relationship of historical continuity between the constitutional state with the rule of law, on the one hand, and the cosmopolitan state, on the other hand. These reflections derive from a particular way of understanding the relevant concepts and involve the nature of the theory of law, whether descriptive or prescriptive.
