The High Court of Justice qualifies as ''self-laundering '' the use, in the gambling sector, of moneys withdrawn from a previous fraud, replicating, with numerous and sophisticated arguments, to the objections inferred from the contested order and from a previous judgment of the same Court. The controversy, however, is perhaps based on a misunderstanding, which in essence leads to confusing the requirements for the actus reus (in this case, "playing games of chance") with those related to the "activity" in the direction in which the actus is to be performed (the "game of chance "). In any case, the ruling offers interesting ideas for "taking stock" of a recent and controversial crime provision.
La Cassazione qualifica come ‘‘autoriciclaggio’’ l’impiego nel settore del gioco e delle scommesse dei proventi ritratti da una precedente truffa, replicando, con numerosi e sofisticati argomenti, alle obiezioni desumibili dall’ordinanza impugnata, e da un precedente contrario dello stesso giudice di legittimità . La controversia, tuttavia, è forse viziata da un equivoco di fondo, che in buona sostanza porta a confondere i prerequisiti richiesti per la tipicità della condotta (nel caso di specie, ‘‘giocare d’azzardo’’), con quelli relativi alla tipologia di ‘‘attività’’ in direzione della quale la condotta tipica deve essere compiuta (il ‘‘gioco d’azzardo’’). La decisione offre, comunque, interessanti spunti per ‘‘fare il punto’’ su di una disposizione incriminatrice recente e controversa.
