Nearly ten years after the well known "Giulini" judgment, the ruling of the Preliminary Hearing Judge at the Tivoli Court offers the opportunity to talk about the criminal relevance of the medical interventions practised against the patient's dissent (expressed through a representative); furthermore, in regards to the debate about the refusal of lifesaving medical treatment, the arbitrary medical interventions and the defense of necessity (Art. 54 c.p.).
A quasi dieci anni dalla nota sentenza a Sezioni Unite «Giulini», la pronuncia del Giudice per le indagini preliminari presso il Tribunale di Tivoli offre l’occasione per tornare a parlare della rilevanza penale dell’atto medico attuato contro il dissenso del paziente (espresso attraverso un rappresentante, nel caso di specie un amministratore di sostegno); nonché per fare il punto sull’acceso dibattito circa il rifiuto di cure salvavita, i trattamenti sanitari coatti e il rilievo dello stato di necessità (art. 54 c.p.)
