The United Kingdom, France, and Italy share a frequent and massive use of delegated legislation, so much so that in each of these experiences there has been mention of a substantial abuse of it. This essay will first reconstruct the discipline legitimizing the institution. Then it will highlight the main critical issues connected to the use of delegated legislation in these three experiences and attempt to identify the reasons that, despite the differences that distinguish them, have led to the growing use of delegated legislation.

Abstract

The United Kingdom, France, and Italy share a frequent and massive use of delegated legislation, so much so that in each of these experiences there has been mention of a substantial abuse of it. This essay will first reconstruct the discipline legitimizing the institution. Then it will highlight the main critical issues connected to the use of delegated legislation in these three experiences and attempt to identify the reasons that, despite the differences that distinguish them, have led to the growing use of delegated legislation.
