The paper focuses on the dual purpose contracts regime in the light of the EU definition of consumer, as well as based on the ECJ’s reading of the requirement that the consumer must act outside his trade, business, craft or profession. The coexistence – and the consequent need for coordination – between the criteria of “non-predominance” and “negligibility” of the trade purpose, respectively set out in recital 17 of Directive 2011/83/EU and in the Gruber judgment, prompts some reflections on the current meaning of the notion of consumer and its qualification in terms of status.

Il contributo si sofferma sul regime dei contratti con scopo promiscuo alla luce della definizione eurounitaria di consumatore, nonché alla stregua dell’interpretazione della Corte di Giustizia circa il presupposto della estraneità dell’affare rispetto all’attività imprenditoriale, commerciale, artigianale o professionale eventualmente svolta dal contraente. La coesistenza – e la conseguente esigenza di coordinamento – fra i parametri della “non predominanza” e della “trascurabilità” dello scopo commerciale, rispettivamente enunciati nel 17° considerando dir. (UE) 2011/83 e nella sentenza Gruber, stimola alcune riflessioni sull’attuale significato della nozione di consumatore e sulla sua riconducibilità entro lo schema, per definizione statico, dello status.
