FECONDAZIONE POST-MORTEM ED IL PERCORSO COMPIUTO: DA SCIENTIFICAMENTE POSSIBILE A REALISMO NORMATIVO

Il tema della procreazione assistita post-mortem è stato oggetto di un continuo dibattito dottrinario con posizioni che tendono a privilegiare, da un lato, l’interesse del nascituro a vivere in una famiglia bigenitoriale, dall’altro il diritto dell’embrione, già formato, di nascere in totale corrispondenza anche al diritto alla salute ed alla autodeterminazione della futura madre. La questione è stata affrontata più volte dalla giurisprudenza di merito, qui analizzata. Infine, le recentissime linee guida ministeriali in materia di procreazione medicalmente assistita sembrano aver posto, definitivamente, un punto fermo a favore della procreazione post-mortem. The issue of post-mor tem assisted procreation has been the subject of continuous doctrinal debate with positions that tend to favor, on the one hand, the interest of the unborn child in living in a two-parent family, and on the other the right of the embryo, already created, to be born in total correspondence also with the future mother’s right to health and self-determination. The issue has been addressed several times by the jurisprudence, analyzed here. Finally, the very recent ministerial guidelines on medically assisted procreation seem to have definitively established a firm point in favor of post-mortem procreation.
