This article analyses whether and in what extent the new trade agreement between EU and Mexico plays a role in the international governance of the environment. This could be a far-fetched issue given that it is an agreement that seems to be doubly limited: materially (since it is a trade agreement) and geographically, since it is a bilateral agreement that only concerns the European Union and Mexico. However, the analysis of the legal provisions of the agreement shows that it can, to a certain extent, contribute to the international governance of the environment. This is possible because the agreement does not only contain provisions on trade liberalisation. Indeed, following the model of the new-generation trade agreements of the European Union, it also contains provisions on sustainable development and, in particular, on environmental protection. Moreover, even if these provisions could still be improved, they are with no doubt more advanced than those in force in the general international law, also in view of the difficulties WTO is currently facing. Thus, they can serve as a model for the whole international community.

L’articolo analizza se ed in che misura il nuovo accordo commerciale tra Unione Europea e Messico possa svolgere un ruolo nella governance internazionale dell’ambiente. La questione potrebbe sembrare peregrina, dato che si tratta di un accordo apparentemente doppiamente limitato, sul piano materiale (in quanto appunto si tratta di un accordo commerciale) e sul piano spaziale essendo un accordo di tipo bilaterale che riguarda solo l’Unione Europea e il Messico. L’esame delle norme giuridiche contenute nell’accordo stesso indica, tuttavia, che effettivamente esso può, in una certa misura, contribuire alla governance internazionale dell’ambiente. Ciò è possibile in quanto, in primo luogo, l’accordo non solo contiene disposizioni relative alla liberalizzazione degli scambi commerciali ma, seguendo il modello degli accordi 200 Por: Leonardo Pasquali commerciali di nuova generazione dell’Unione Europea, contiene anche disposizioni sullo sviluppo sostenibile e, in particolare, sulla protezione dell’ambiente. Si tratta, inoltre, di norme che, pur perfettibili, risultano indubbiamente più avanzate rispetto a quelle vigenti nel diritto internazionale globale, anche alla luce delle difficoltà che sta attraversando l’OMC. Possono pertanto fungere da modello per l’intera comunità internazionale.
