La tutela dell’ambiente interno ed esterno all’impresa. Il fondamento giuridico e gli strumenti per una prevenzione integrata.

The essay analyses the relationship between the protection of the work environment and the protection of the environment outside the company, examining the possibility of remodeling the employer’s safety obligation, as well as the legal basis and possible tools for an integrated prevention system. Once outlined connections between labour and environment in an international and EU context, the paper focuses on the occupational health and safety domestic legislative framework. After examining the critical aspects of a reinterpretation of article 2087 of the Italian Civil Code in terms of sustainability, the work deals with interpretation of the environmental references in articles 2(n) and 18(q) of Legislative Decree no. 81/2008, in the framework of the new Article 41 of the Constitution and Article 2086 of the Italian Civil Code. Finally, the essay highlights the potential of participatory methods in the organization of company production processes, through the involvement of workers, their representatives, and other stakeholders.

Il saggio affronta il tema del rapporto tra la tutela dell’ambiente di lavoro e la tutela dell’ambiente esterno all’impresa, proponendo una riflessione sull’opportunità di ridefinire le coordinate dell’obbligo di sicurezza nonché sul fondamento giuridico e sui possibili strumenti per un sistema di prevenzione integrata tra ambiente interno ed esterno all’impresa. Ricostruite le principali tracce di connessione tra lavoro e ambiente nel contesto internazionale ed eurounitario, la riflessione si concentra sull’analisi della disciplina interna in materia di salute e sicurezza sul lavoro. In particolare, dopo aver esaminato le criticità di una rilettura dell’art. 2087 c.c. in chiave di sostenibilità, il contributo approfondisce il significato da attribuire ai riferimenti all’ambiente esterno presenti negli artt. 2, lett. n. e 18, lett. q, del d.lgs. n. 81/2008, da interpretare alla luce del nuovo art. 41 Cost. e dell’art. 2086 c.c. Il saggio, infine, valorizza le potenzialità dei metodi partecipativi nell’organizzazione dei processi produttivi dell’impresa, attraverso il coinvolgimento dei lavoratori, delle loro rappresentanze e degli altri stakeholders.
