IL PROGETTO IUSTIDIA (BUONE PRATICHE E MODELLI DI REGOLAMENTAZIONE PER L'IMPIEGO DELLA IA NELLA DIAGNOSTICA PER IMMAGINI). UNA PANORAMICA.

IustiDIA project has been a constructive challenge, both in terms of method and content. As for the method, it had to become not only multidisciplinary, but, more appropriately, transdisciplinary, i.e. focused on a close and continuous dialogue between the scientific sectors involved – which also took the form of the peculiar ‘questions and answers’ articulation of the policy paper – in order to elaborate a common semantics and to overcome misunderstandings due to the diversity of languages and practices. As for the contents, it was a task of drawing, from ex post evaluations on the areas of criminal and tort liability deriving from the use of AI in medical imaging, ex ante recommendations, useful to divert the doctor from defensive temptations, and to guide the IT specialist so that he designs the best systems (more transparent and ‘dialoguing’) also for the legal practitioner, who is called upon to reconstruct with appropriate rigour, retrospectively, the premises of a possible liability. Lastly, the key word of the project is undoubtedly ‘trust’: trust as the foundation of a method that is, indeed, transdisciplinary, and the principle of trust as the legally relevant rationale that has to, and even more will have to, guide the interactions between the medical practitioner and the ‘response’ provided by the device.

Il progetto IustiDIA si è rivelato una sfida costruttiva, per metodo e per contenuti. Quanto al metodo, esso ha dovuto farsi non solo multidisciplinare, bensì, più propriamente, transdisciplinare, incentrato cioè su di un dialogo serrato e continuo tra i settori scientifici coinvolti – che si è sostanziato anche nella peculiare articolazione “per domande e risposte” del policy paper – allo scopo di elaborare una semantica comune, e di superare fraintendimenti dovuti alla diversità di linguaggi e prassi. Quanto ai contenuti, si è trattato di trarre, da valutazioni ex post circa spazi di responsabilità penale e civile derivante dall’uso di IA nella diagnostica per immagini, indicazioni ex ante, utili a distogliere il medico da tentazioni difensivistiche, e ad orientare l’informatico affinché progetti i sistemi migliori (più trasparenti e “dialoganti”) anche per l’operatore del diritto, chiamato a ricostruire con il dovuto rigore, retrospettivamente, i presupposti di una possibile responsabilità. Parola chiave del progetto è infine, senz’altro, “fiducia”: fiducia come fondamento di un metodo, appunto, transdisciplinare, e principio di affidamento come logica giuridicamente rilevante che deve, e ancor più dovrà, guidare le interazioni tra medico e “responso” fornito dal dispositivo.
