The contribution questions the content of Constitutional Law No. 1 of 2023, which, by integrating the content of Article 33 of the Constitution, provided for the Republic's recognition of the 'educational, social and psychophysical wellbeing-promoting value of sporting activity in all its forms'. A constitutional reform that had been sought after for a long time, but about which very little was discussed at the level of constitutional doctrine during the drafting and approval stage, whose regulatory scope, effects in the legal system, consequences on the education system, on health profiles and even on the health organization must, however, be carefully identified.
