Le azioni rappresentative nel codice del consumo

The study describes the new representative actions regulated by the articles 140-ter and followings, introduced into the consumer code by the legislative- decree 11 march 2023, n. 28, in implementation of the directive 2020/1828/ UE issued on 5 november 2020. Particularly, it provides a qualification and a systematic framework, especially in relation to the collective proceedings regulated in the articles. 840-bis and followings of the code of civil procedure, representative injunction action and representative compensatory action. It also critically addresses the assumptions and characteristics of these tools, suggesting perspectives for future evolutions.

Lo studio descrive le nuove azioni rappresentative disciplinate dagli artt. 140-ter ss., introdotti nel codice del consumo dal d.lgs. 11 marzo 2023, n. 28, in attuazione della direttiva 2020/1828/UE del 25 novembre 2020. In particolare fornisce una qualificazione ed un inquadramento sistematico, in rapporto soprattutto ai procedimenti collettivi di cui agli artt. 840-bis ss. del codice di procedura civile, dell’azione rappresentativa inibitoria e dell’azione rappresentativa compensativa. Affronta anche criticamente i presupposti e le caratteristiche di tali strumenti, suggerendo prospettive per evoluzioni future.
