The document published here, updated to the latest relevant legal novelties of 2024, represents the result of the research work carried out within the IustiDIA project. After some defining premises, it analyses the topic of the use of artificial intelligence in medical imaging from the different legal – itself distinguished in criminal and private law -, medical and IT points of view, as far as possible declined in relation to concrete application problems, maintaining however, between them, a close interaction by virtue of mutual questions and answers. From the text of the paper, and from the conclusions (intended to suggest an intermediate way between an ‘efficientistic’ and a ‘individualising’ approach), arise indications that are hopefully useful in orienting the use of AI in the medical field in such a way as to optimise its positive potential, for the patient’s health and the efficiency of healthcare systems, while reducing the risk of tort or criminal liability on the other hand. The text is provided with an exhaustive bibliography.
Il documento qui riprodotto, aggiornato alle ultime novità normative rilevanti del 2024, rappresenta il risultato finale del lavoro di ricerca compiuto nell’ambito del progetto IustiDIA. Poste alcune premesse definitorie, esso analizza il tema dell’uso della intelligenza artificiale nella diagnostica per immagini dai diversi punti di vista giuridico – a sua volta distinto in penalistico e privatistico -, medico e informatico, il più possibile declinati in rapporto a concrete problematiche applicative, mantenendo tuttavia, tra di essi, una stretta interazione in virtù di reciproche domande e risposte. Dal testo dell’elaborato, e dalle conclusioni (intese a suggerire una via intermedia tra approccio “efficientista” ed altro “personalizzante”) emergono indicazioni auspicabilmente utili ad orientare l’impiego della IA in ambito medico in modo da ottimizzarne le potenzialità positive, per la salute del paziente e l’efficienza dei sistemi sanitari, riducendo su altro fronte il rischio di responsabilità civile o penale. Il testo è corredato da un’ampia bibliografia.
