Examining the nexus between electoral systems and forms of government, this paper presents a comparative analysis of the constitutional convention that identifies the Prime Minister with the leader of the winning party in parliamentary elections. This convention appears more straightforwardly established in the presence of a majoritarian electoral system (as seen in the UK), as well as in countries where proportional representation electoral systems are modified to yield majoritarian effects (such as in Germany and Spain). Furthermore, this principle has been invoked at the EU level, notably in the unsuccessful attempt to implement the Spitzenkandidat method for electing the President of the Commission.
