This paper analyses how the European Green Deal is reshaping the legal and institutional framework of credit support. Public intervention now relies more on financial instruments inspired by the private sector than on traditional subsidies. At the same time, private investment is being mobilised through proactive public mitigation of risk, even in the absence of market failure. The study highlights the growing legal significance of selective State aid and the enhanced role of national promotional banks. Both are emerging as key tools for aligning credit allocation with the EU’s climate and industrial policy goals.
Il contributo analizza come il Green Deal europeo stia trasformando il sistema normativo e istituzionale del sostegno al credito. Da un lato, l’intervento di sostegno pubblico si avvale di strumenti finanziari tipici del settore privato, piuttosto che delle tradizionali sovvenzioni. D’altro, la mobilitazione delle risorse private avviene attraverso un intervento pubblico proattivo a mitigazione dei rischi, in assenza di un fallimento del mercato. Il saggio si sofferma poi ad esplorare la rilevanza giuridica che in questo contesto stanno assumendo gli aiuti di stato selettivi e le banche pubbliche di promozione.
