Turning an eye to the last decades of the Spanish ius commune legal experience, the essay attempts to reconstruct some of the interpretive dynamics concerning the qualification of things (res), mainly through an examination of the reflections of Instituta professors between the eighteenth and nineteenth centuries; reflections which, while remaining anchored to the framework provided by Roman sources, must primarily take into account Canon Law and, subsequently, the increasingly intense interventions of the iura propria.
Volgendo lo sguardo agli ultimi decenni dell’esperienza giuridica spagnola del diritto comune, il saggio tenta di ricostruire alcune delle dinamiche interpretative sulla qualificazione delle cose, principalmente attraverso l’esame delle riflessioni dei professori di Instituta fra Sette e Ottocento; riflessioni che, pur rimanendo ancorate al canovaccio costituito dalle fonti romane, debbono tener conto in primo luogo del diritto canonico e poi dei sempre più intensi interventi degli iura propria.
