In my book Identità e continuità dello Stato, I have attempted to point out the juridical meaning for the two notions referred to in the title. They must be conceptually distinguished from the notion of succession between States, showing that they are not simply its negative counterpart. However, this is only possible, in my view, by going beyond the ordinary epistemological principles that explain the nature and functioning of the State. Consequently, a philosophy of the State must be at the same time a philosophy in the classical sense; and to develop it, Hauriou’s doctrine is a firmer support than Kelsen’s
