This article examines critically the evolution of the European Union (EU)’s anti-money laundering and countering the financing of terrorism (AML/CFT) framework, focusing on the transition from the minimum harmonisation model based on directives to the Single Rulebook established by the 2024 legislative package. After analysing the influence of the Financial Action Task Force (FATF) standard on the development of EU law, the study explores the evolution of harmonisation techniques in light of Article 114 TFEU and the relevant case law of the Court of Justice of the EU. Particular attention is devoted to the relationship between regulatory uniformity and effective enforcement, as well as to the role of the Anti-Money Laundering Authority (AMLA). The article argues that the new framework represents not only a higher degree of legal harmonisation, but also a broader transformation of EU governance towards more advanced forms of supranational coordination and supervision.
Il contributo analizza criticamente l’evoluzione della disciplina dell’Unione europea (UE) in materia di prevenzione del riciclaggio di denaro e del finanziamento del terrorismo (AML/CFT), soffermandosi sul passaggio dal modello di armonizzazione minima fondato sulle direttive al nuovo Single Rulebook introdotto dal pacchetto legislativo del 2024. Dopo aver esaminato l’influenza esercitata dagli standard del Gruppo d’Azione Finanziaria Internazionale/Financial Action Task Force (GAFI/FATF) sullo sviluppo del diritto dell’UE, ci si sofferma sull’evoluzione della tecnica di armonizzazione alla luce dell’art. 114 TFUE e sulla relativa giurisprudenza della Corte di giustizia dell’UE. Particolare attenzione è dedicata al rapporto tra uniformità normativa ed effettività applicativa, nonché al ruolo dell’Autorità europea per la lotta al riciclaggio e al finanziamento del terrorismo (AMLA). Si sostiene che il nuovo assetto non rappresenti soltanto un rafforzamento dell’armonizzazione giuridica, ma anche un’evoluzione della governance dell’Unione verso forme più avanzate di coordinamento e supervisione sovranazionale.
