The article critically analyses, in the light of Italian Constitutional Court judgment No. 63 of 2026, the retroactive effects of the citizenship reform introduced in 2025 and their impact on the relationship between national citizenship and European Union citizenship. The analysis focuses, in particular, on the distinction between recognised and unrecognised status, on the criterion of the genuine link, and on the limits deriving from the principle of proportionality, including the absence of an individual assessment and of an effective transitional regime. The article also examines the implications of the refusal to make a preliminary reference to the Court of Justice of the European Union and the relevance of the ECHR and of international norms protecting fundamental rights in relation to retroactive measures affecting status civitatis.

Il contributo analizza criticamente, alla luce della sentenza della Corte costituzionale n. 63 del 2026, gli effetti retroattivi della riforma della cittadinanza introdotta nel 2025 e il loro impatto sul rapporto tra cittadinanza nazionale e cittadinanza dell’Unione europea. L’attenzione si concentra, in particolare, sulla distinzione tra status accertato e non accertato, sul criterio del “legame effettivo” e sui limiti derivanti dal principio di proporzionalità, anche con riguardo all’assenza di un esame individuale e di un’effettiva disciplina transitoria. Vengono inoltre esaminate le implicazioni del mancato rinvio pregiudiziale alla Corte di giustizia e il rilievo della CEDU e delle norme internazionali a tutela dei diritti fondamentali rispetto a discipline retroattive incidenti sullo status civitatis.
