This paper examines the implications that the approval of Regulation (EU) 2024/1689 on artificial intelligence (AI Act) will have on Italian criminal proceedings. In the investigative context, various forms of AI have been already deployed, mainly to identify persons under investigation, but also to optimize scientific analysis or predict future criminal events. This work aims, first of all, to systematize the known uses of AI in criminal proceedings, distinguishing between systems used for crime prevention, investigation, and judicial support. At the same time, it assesses the impact of the AI Act on the future of these technologies, verifying when their use is permitted, when it is allowed within certain limits, and when it is prohibited. The aim is therefore to provide Italian legal practitioners with a systematic guide to new artificial intelligence technologies.
