The paper analyzes the development of the jurisprudence of the Italian Constitutional Court and of the Spanish Constitutional Court on the primary normative powers of the Government, trying to highlight the different stages of the constitutional control in this field. Both for the Decree Law and the Legislative Delegation have been taken into consideration: a) the first decisions with which the Constitutional Judges had declared its jurisdiction to control the proper use of such institutes; b) the decisions of the first half of 2000, with which it is made more “strict” the constitutional control; c) the decisions taken in the years of “crisis”, from 2008 to the most recent judgments of 2016, in which important declarations of unconstitutionality took turns judgments more “reverential” towards the Executive’s decisions.
