Lo scritto affronta il tema dei poteri normativi dell’Esecutivo negli Stati Uniti. Muovendo dal tentativo di ricostruire la relazione tra la scelta costituzionale dell’Esecutivo unitario ed esercizio di poteri unilaterali da parte del Presidente, nel contesto del peculiare modello di separazione dei poteri proprio del sistema nord-americano, esso studia la natura e le modalità con le quali il Presidente degli Stati Uniti adotta atti (unilaterali) aventi force and effects of law, soffermandosi in particolare sull’evoluzione storica e le prospettive nell’utilizzo di executive orders e signing statements, ma anche sul rapporto tra potere di veto e signing statements, e sul significato che la legislazione delegata assume nel sistema costituzionale preso in considerazione. The paper studies the legislative powers of the Executive in the United States. It investigates the relationship between the constitutional model of the Unitary Executive and the unilateral presidential powers, in the context of the peculiar system of separation of the powers of the North American constitutionalism, discussing the nature and the ways in which the President of the United States makes (unilateral) acts having force and effects of law. The paper focuses in particular on the historical evolution and perspectives in the use of executive orders and signing statements, but also on the relationship between veto power and signing statements, and on the meaning of delegated legislation in the US constitutional system.
