The essay aims to put in evidence the position of the President of the Fifth Republic in the field of defence policy. The distribution of competences among the President and the Prime Minister organised by the constitution of 1958 appears to be rather ambigous. Indeed, according to the wording of the constitution, on one side, the President of the Republic is the “Commander in Chief of the Armed Forces” (art. 15) and is responsible for ensurring that national independence and the country’s integrity are maintained and that treaties are respected (art. 5); on the other, the Prime Minister is “responsible for national defence” (art. 21). Originally, the Prime Minister was mean to take on the leading role in the field of defence, but the istitutional pratice adopted after 1958 by General de Gaulle (as first President of the Fifth Republic) and later by all the other Presidents altered the original scheme of constitution: the competences of the President have become more substantial (he is the only person empowered to give the order to engage nuclear forces), while the prerogatives of the Prime Minister, also during the political situation of cohabitation, have been shown to be merely formal.

Uno dei profili caratterizzanti l’attuale regime francese è la preminenza del Capo dello Stato nel settore della difesa nazionale, affermatasi nella prassi politico-istituzionale nonostante le rilevanti prerogative nella materia riconosciute dalla Costituzione al Primo Ministro e al Governo. La Carta del 1958 prevede che il Governo disponga delle forze armate e riconosce il Primo Ministro come il «responsabile della difesa nazionale», mentre il Presidente della Repubblica, quale «garante dell’indipendenza nazionale, dell’integrità del territorio e del rispetto dei trattati», è «il Capo delle forze armate» ed è autorizzato a concentrare nelle proprie mani i poteri dello Stato in circostanze eccezionali. L’ambivalenza del testo costituzionale e la pratica istituzionale adottata dal Generale de Gaulle hanno tuttavia consentito al Presidente della Repubblica di esercitare in modo sostanziale le proprie prerogative costituzionali, attribuendo al titolo di «Chef des armées» una consistenza riconducibile a quella di un «autentico Commander in chief». Così, tutti i Presidenti della Repubblica eletti dopo de Gaulle – da Pompidou a Macron – hanno esercitato le proprie prerogative di Chef des armées, mantenendo tanto il potere supremo di comando dell’arsenale atomico quanto un ruolo decisionale riguardo la direzione della politica di difesa, l’impiego delle forze armate e, più recentemente, la definizione della più articolata strategia di sicurezza nazionale contro le nuove minacce, di natura non strettamente militare, rivolte contro il Paese.
