The article analyses a judgment of the Italian Supreme Court (Corte di Cassazione) that deals with the award of non-pecuniary damages as a remedy for noise nuisance. Despite no health injury was ascertained, the judges nonetheless admit the claimant was prejudiced in his enjoyment of his own home as a freestanding right which deserves compensation. Firstly, the paper focuses on the relations between art. 844 c.c. and non-pecuniary damage; secondly, it provides a critical analysis of the main arguments developed in the judgement on the relevance of both art. 42, par. 2, Cost., and the right to respect for home (art. 8 ECHR) in the case at issue.
L’articolo analizza una pronuncia delle Sezioni Unite in cui si ammette la risarcibilità del danno non patrimoniale derivante da immissioni illecite. Pur in assenza di un danno biologico accertato, il giudice di legittimità ha ammesso l’esistenza di una lesione del godimento della propria abitazione. Alla ricostruzione del rapporto intercorrente tra l’art. 844 c.c. e il danno non patrimoniale seguirà l’analisi critica delle argomentazioni della Corte in merito alla rilevanza, rispetto al caso di specie, dell’art. 42, comma 2, Cost., e del diritto inviolabile all’abitazione (art. 8 CEDU).
