Objective Dangerousness and Criminal Policies in the Current Italian Penal System. The Danger Crimes in the Era of Internet.

Dealing with the category of dangerousness as an object of criminal charges in Italian law, the essay addresses certain declinations of the so-called dangerous crimes. The object of analysis are in particular those types of crime which have seen renewed methods of application thanks to the advent of information and telematic technologies: above all, association crimes, terrorist crimes and so-called crimes of opinion are examined. For these crimes the possibility of being carried out via the internet has posed delicate problems of qualifying the fact and ascertaining whether the crime has been committed.

Trattanto della categoria della pericolosità come oggetto di incriminazioni nel diritto penale italiano, il saggio affronta talune declinazioni dei cosiddetti reati di pericolo. Oggetto di analisi sono in particolare quei tipi di reato che hanno conosciuto rinnovate modalità applicative grazie all'avvento delle tecnologie informatiche e telematiche: sono presi in esame soprattutto i reati associativi, i reati di terrorismo e i c.d. reati di opinione, per i quali le possibilità di realizzazione attraverso internet ha posto delicati problemi di qualificazione del fatto e di accertamento dell'avvenuta commissione del reato.
