La riflessione sulla dimensione sensoriale del sistema normativo conduce ad interrogarsi sulle modalità con le quali il diritto si costruisce nel rapporto con i sensi e su come i sensi siano costruiti dal diritto. Alcuni ambiti del settore alimentare e, in particolare, dei vini sono significati al riguardo: il settore dei marchi, dei disciplinari, dei panel di valutazione della qualità, dell’evoluzione delle pratiche legate al cambiamento climatico risentono del rapporto performativo fra il diritto e i sensi. Ogni società si struttura sulla base di un sistema di valori e regimi sensoriali e normativi intorno al cibo. Cogliere il dinamismo dell’esperienza sensoriale e normativa significa approfondire la conoscenza del sistema normativo vigente, dei suoi limiti e di quelli dell’analisi sensoriale e affrontare anche la sfida del “superamento dell’umano” senza dimenticare le conseguenze dell’abbandono dell’individuo. Reflection on the sensory dimension of the regulatory system leads us to question how law is constructed in relation to the senses and how the senses are constructed by law. Some areas of the food sector, and in particular wine, are significant in this regard: the sector of trademarks, regulations, quality assessment panels, and the evolution of practices related to climate change are affected by the performative relationship between law and the senses. Every society is structured around a system of values and sensory and regulatory regimes relating to food. Understanding the dynamism of sensory and regulatory experience means deepening our knowledge of the current regulatory system and its limitations, as well as those of sensory analysis, and also addressing the challenge of ‘transcending the human’ without forgetting the consequences of abandoning the individual.
